Robosparks Ltd – Terms and Conditions
1. Definitions
“We”, “Us”, “Our” means Robosparks Ltd, 16268749.
“You”, “Customer” means the person or entity requesting or receiving our services.
“Services” means the electrical installation, repair, inspection, testing, maintenance or related work described in any quotation, estimate or order confirmation.
“Materials” means any goods, parts or equipment supplied by Us.
“Contract” means the agreement between You and Us incorporating these Terms.
2. Scope of Services
2.1 We will provide the Services with reasonable care and skill in accordance with applicable UK electrical regulations (including BS 7671 Wiring Regulations) and good industry practice.
2.2 The precise scope is as set out in our written quotation or order confirmation. Any additional work will be treated as a variation (see clause 6).
2.3 We are not responsible for pre-existing faults, latent defects, or work carried out by others unless expressly agreed in writing.
2.4 We specifically exclude liability for damage to carpets and other floor coverings, liability for decoration and re-plastering from our works.
2.5 We do not inspect and test lofts, attic spaces, below floors, behind walls or areas that are not readily accessible (such as eaves etc)
2.6 Areas outside the main property, such as garages and huts are not included in any quoted cost for an EICR unless they are detailed separately.
3. Quotations and Acceptance
3.1 Quotations are valid for [30] days unless otherwise stated and are based on the information You provide and a visual inspection where applicable.
3.2 A Contract is formed when You accept our quotation in writing (including email or text) or when We commence work with Your agreement.
3.3 Estimates are approximate only; fixed-price quotations are binding subject to the conditions below.
3.4 Works over £500 will require a 30% materials deposit upfront to cover costs. Then the remaining balance after completion (unless agreed otherwise).
3.5 Any estimated costs given for inspection and testing are based on a single consumer unit with a standard single rate(non-off-peak) supply.
4. Price and Payment
4.1 The standard attendance fee is £85 for the first hour then an hourly rate of £65 per hour after.
4.2 The standard working week runs from Monday – Friday 8:30am – 5:00pm excluding bank holidays. All other times may be considered out of hours. Invoices are usually raised at the end of the job- payment is required on completion of electrical works.
4.3 Payment is required on any outstanding invoices prior to any continuation of further works for the same client.
4.4 Prices are exclusive of VAT unless stated otherwise. VAT will be charged at the prevailing rate. Due to increasing card transaction costs we no longer offer routine card payments, however we can offer card payment for emergency call out and certain specific jobs- any card payment request needs to be authorised by us at the job quotation stage. The 3% card charge fee will be added to the cost.
4.5 Payment is due as follows: 30% deposit on acceptance / balance on completion / staggered payments for larger jobs / payment within 7/14 days of invoice. Cheques are no longer accepted.
4.6 We may charge interest on overdue amounts at 3% above the Bank of England base rate, plus reasonable recovery costs.
4.7 Title to Materials remains with Us until paid for in full. Risk passes on delivery/installation.
4.8 We provide certification for our jobs- we supply a full signed certificate once payment is received.
4.9 Any additional consumer units may incur an additional cost of at least £40 plus a cost of £25.00 per circuit
5. Access and Customer Obligations
5.1 You must provide safe, reasonable access to the premises, electricity supply (where needed), and clear working space at the agreed times.
5.2 You are responsible for obtaining any necessary permissions, consents or notifications (e.g. landlord approval, Building Regulations notifications where applicable).
5.3 You must inform Us of any known asbestos, structural issues, or other hazards.
5.4 Failure to provide access or required information may result in additional charges or delay.
6. Variations and Additional Work
6.1 Any changes requested by You or required due to unforeseen circumstances will be quoted separately and require Your written agreement before proceeding.
6.2 We will not be obliged to carry out extra work until the variation is agreed and any additional payment arranged.
7. Cancellation and Cooling-Off
7.1 If You are a consumer and the Contract was concluded away from our premises or by distance means, You may have a 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
7.2 To cancel, notify Us in writing. If work has begun with Your express request during the cooling-off period, You may be charged for work already performed and Materials used.
7.3 If materials are ordered and a job is subsequently cancelled the client will be liable for any costs or time used to return the order, this may include wholesaler charges.
7.4 Outside any cooling-off rights, cancellation by You may incur reasonable costs for time, Materials ordered, and loss of profit.
7.5 We may cancel or suspend work if You fail to pay, provide access, or if circumstances make performance unsafe or impractical.
7.6 Out of hours / emergency response works are NOT CANCELLABLE once arranged; if works are subsequently cancelled charges will still apply.
7.7 If we have been on site to give advice and a job is subsequently cancelled within this 14-day period, then we may make a charge (based on time used surveying / giving professional advice / travelling to and from site).
8. Performance and Time
8.1 Time is not of the essence unless expressly agreed in writing. We will use reasonable endeavours to meet agreed dates but are not liable for delays caused by circumstances beyond our reasonable control (including supply shortages, weather, or Your actions).
9. Warranties and Defects
9.1 We warrant that the Services will be carried out with reasonable care and skill and that Materials will be of satisfactory quality and fit for purpose (subject to manufacturer warranties).
9.2 Any guarantee period (12 months on workmanship) will be stated in writing. Manufacturer warranties on Materials are passed on where applicable.
9.3 You must notify Us promptly of any alleged defect. We will, at our option, repair, re-perform or refund the relevant part of the Services.
9.4 These rights are in addition to your statutory rights under the Consumer Rights Act 2015 (where applicable).
10. Liability
10.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.
10.2 Subject to 10.1, our total liability under the Contract is limited to the total price paid (or payable) for the Services.
10.3 We are not liable for indirect, consequential or pure economic loss, loss of profit, or damage arising from Your failure to follow advice or maintain the installation.
10.4 We maintain public liability insurance of at least £2 million – details available on request.
11. Health and Safety
11.1 We will comply with relevant health and safety legislation. You must not interfere with our work or create unsafe conditions.
11.2 Electrical isolation and safe systems of work will be followed. We may refuse to work if conditions are unsafe.
12. Data Protection
12.1 We process personal data in accordance with UK GDPR and the Data Protection Act 2018. See our Privacy Notice [link or available on request] for details of how we collect, use and store Your information.
13. Complaints
13.1 Please raise any concerns with Us promptly. We aim to resolve complaints fairly and quickly. If unresolved, You may contact [relevant trade body / Alternative Dispute Resolution provider] or seek advice from Citizens Advice / Trading Standards.
14. General
14.1 These Terms constitute the entire agreement and supersede prior discussions.
14.2 If any provision is found unenforceable, the remainder continues in force.
14.3 No waiver is effective unless in writing.
14.4 We may subcontract or assign the Contract; You may not without our consent.
14.5 These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction (subject to consumer rights to bring claims in Your local courts).
